Terms of Service

The Service provides educational feedback on college application essays, including automated evaluations generated by artificial intelligence, and tools to help you develop your own essay topics and outlines.

The Service is an educational tool. It is not a college counseling relationship, and nothing in the Service constitutes a promise or prediction about your admission to any college or university.

We do not write essays. The Service evaluates and guides your own writing. It will not generate essay text for you to submit as your own, and you agree not to attempt to use it for that purpose. Your essays must be your own work.

We are not affiliated with any college or university. References on our site to specific schools describe the factual outcomes of students we have worked with. All school names and marks are the property of their respective institutions, and no affiliation, sponsorship, or endorsement is claimed or implied.

You must be at least 13 years old to use the Service.

If you are under 18, you may use the free features of the Service only with the knowledge and permission of a parent or legal guardian, and all purchases must be made by a parent or legal guardian who is at least 18 years old and who agrees to these Terms on your behalf.

College admissions decisions depend on many factors outside anyone's control, including institutional priorities, applicant pools, and holistic review processes. We make no guarantee, representation, or warranty that using the Service, free or paid, will result in admission to any institution, an improved admission outcome, or any particular evaluation score from any admissions office. Statistics and testimonials on our site describe past outcomes of individual students and are not a promise of future results.

Evaluations, scores, feedback, and suggestions produced by the Service are generated by artificial intelligence. AI output can be incomplete, inconsistent, or wrong. Evaluations reflect our rubric and methodology, not the views of any admissions office. You are responsible for exercising your own judgment about your essay and your application. The Service is a supplement to, not a substitute for, your own thinking and, where available, guidance from counselors, teachers, and parents.

You own your essays. Submitting a draft to the Service does not transfer any ownership to us. You grant us a limited license to process your submitted text solely to provide the Service (for example, transmitting it to our AI provider to generate your evaluation), as described in our Privacy Policy. As stated there, we do not store your essays or use them to train AI models.

You are responsible for the content you submit. Do not submit content that belongs to someone else, that is unlawful, or that contains another person's personal information.

You are responsible for complying with the academic integrity and application policies of the schools you apply to, including any rules about the use of AI tools in preparing application materials. Policies vary by institution and change over time; checking them is your responsibility. The Service is designed to help you evaluate and improve your own writing, and used that way, it functions like feedback from a teacher or counselor, but the final judgment about what is appropriate for your applications is yours.

Paid products are one-time purchases processed by Stripe. Prices are shown at checkout and may change for future purchases; changes do not affect purchases already completed.

Access period. Each purchase includes access to the purchased tools for the current admissions cycle, defined as through June 30 following your purchase.

Refunds. If the Service is not useful to you, email us at hello@underdogadmissions.com within 7 days of purchase and we will refund you in full, no questions asked. After 7 days, purchases are non-refundable except where required by law.

Fair use of unlimited features. "Unlimited" evaluations are provided for your personal use on your own application essays. We may limit or suspend access that indicates automated use, resale, account sharing, or other abuse.

You agree not to:

• Use the Service to generate or launder text for submission as your own writing
• Resell, share, or provide access to paid features to others
• Use bots, scrapers, or automated tools to access the Service
• Attempt to probe, disrupt, reverse-engineer, or circumvent the Service's security or access controls
• Submit content designed to manipulate, attack, or extract the underlying AI systems
• Use the Service for any unlawful purpose

We may suspend or terminate access for violations of these Terms.

The Service, including our rubric, evaluation methodology, site content, branding, and software, is owned by us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-transferable license to use the Service for your own college application process. You may not copy, republish, or commercially exploit our content or methodology without our written permission.

The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that evaluations will be accurate or complete.

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of opportunity (including admissions outcomes), arising from your use of the Service. Our total liability for any claim arising from the Service will not exceed the amount you paid us in the twelve (12) months before the claim arose, or one hundred dollars ($100) if you have paid us nothing.

Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

We may modify, add, or discontinue features of the Service at any time. We may update these Terms from time to time; if we make material changes, we will update the "Last updated" date and, where appropriate, provide additional notice. Continued use of the Service after changes take effect means you accept the updated Terms. Material changes will not retroactively reduce what you received in a completed purchase.

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination (including Sections 3, 5, 9, 10, 11, and 14) will survive.

These Terms are governed by the laws of the State of Utah, without regard to conflict-of-laws principles. Before filing any claim, you agree to contact us at hello@underdogadmissions.com and attempt in good faith to resolve the dispute informally for at least 30 days. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Utah, and you consent to their jurisdiction.

These Terms, together with the Privacy Policy, are the entire agreement between you and us regarding the Service. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
